Our initial strategy was to convert the former preschool using Class MA Permitted Development Rights.

However, the proposal was refused because the existing building couldn't provide sufficient natural light and ventilation to create high-quality residential accommodation. Like many commercial buildings, the available windows simply weren't in the right locations for modern residential use.

At this point, many projects become significantly more complicated.

Introducing new windows meant a full planning application was required. But that wasn't the only challenge.

Because the building had most recently operated as a preschool, Bromley Council also had to consider the loss of a community facility under Local Plan Policy 20. Before supporting a change of use, the Council required evidence that the existing use was no longer needed.

Fortunately, the previous operator had already demonstrated that the nursery was no longer commercially viable, and the Council's own Early Years Team confirmed there was no identified need for additional nursery provision within the area.However, the policy went further than this.

The Council also had to consider whether the building could accommodate other forms of community or social infrastructure. Normally, this would require a robust six-month marketing exercise to demonstrate there was no realistic demand from alternative community organisations.

In this case, we prepared a detailed planning case explaining why the building was unlikely to be suitable for many alternative community uses. Its residential setting, access constraints, parking limitations and relationship with neighbouring properties all significantly restricted its suitability for other forms of social infrastructure.

Although the Council ultimately acknowledged many of these constraints, they concluded that the absence of formal marketing evidence meant the proposal technically conflicted with Policy 20. The application therefore had to be assessed by balancing this policy conflict against the wider public benefits of delivering two new homes.

This illustrates something many clients don't realise at the outset.

Successful planning applications are rarely just about producing drawings. They involve understanding planning policy, identifying potential risks early, and developing a strategy that gives the project the greatest chance of success before significant time and money are invested.
